The EEA Agreement

The main objective of the EEA Agreement is to create a European Economic Area. The integration of EU legislation with the EEA Agreement ensures that the Single Market is applied uniformly in all the countries of the EEA. The EEA is not a Customs Union or a Monetary Union. The EEA Agreement does not cover common policies in agriculture and fishing, trade, foreign and security, or justice and Home Affairs.

Family permit for EEA and Swiss nationals

If you are a family member of an EEA citizen, you can get the family permit. If you are a family member of a Swiss national coming to the UK, you can also qualify.

UKVI and Covid-19

Covid-19: Due to the Covid-19 or coronaviruses, visa application centers are closed at short notice, sometimes making it impossible for applicants to provide their fingerprints. The UKVI are working through the backlogged cases and are facing delays to the overall processing times.

The omission of the family permits from the right to work legislation has made it difficult for UK employers to hire people who are not in possession of an approved residence document. The employer will not have a statutory excuse against a statutory penalty if they rely on documentary evidence other than a residence card or document issued by UKVI. Non-eea nationals can use their residence cards from the member state to enter the country when accompanying a family member until December 2020.

Processing time of applications for visa requirements in EU countries

The processing times will be different depending on where the application is submitted. The standard processing times are up to six months. The majority of applications are decided in 1-2 months.

The application process will be different depending on where you submit the application and what basis you submit on. Depending on your personal circumstances, supporting a documentary for a family permit evidence may be different. An EU residence document can be used as proof visa requirement in some EU countries.

The First Year EEA Family Program: Application Procedures and Results

If you hold a valid passport and a family permit, you can be admitted to the UK. It is not possible for a non-EEA family member to demonstrate the right to admission under the EU law at the UK border without an EEA family permit. If an extended family member is applying as the dependant of the EEA national, they need to provide proof that they are financially dependent on the national for meeting the essential needs.

The applicants may provide bank statements or details of money transfers from the national to the other. If an application is made for indefinite leave to be a dependant relative of an EEA national, then the person needs to provide evidence of dependency such as bank statements, funds transfer, and other things. The Immigration Rules require that the applicants meet the leave requirements.

If a non-EEA family member is joining a British citizen in the UK, then the British citizen needs to provide evidence that he or she is a qualified person. A family permit from the European Union is valid for 6 months. A non-EEA family member of an EEA national can leave and enter the UK multiple times.

If an ECO decides that the marriage or civil partnership is one of convenience, then they will refuse the EEA family permit application. Marriage or civil partnership is not genuine but convenient. A non-EEA national has a right to appeal if they have a valid passport and proof that they are a family member of an EEA national.

If a non-EEA national does not have a valid passport or evidence to show that they are a family member of an EEA national, they cannot appeal. A non-EEA national needs to file an appeal within 28 days after receiving a refusal letter. 396,939 applications for entry clearance from outside the UK were made during 2005 and 17.

The EEA Family Permit

It is important that you take care when completing the online application form. Failure to complete the form correctly can result in a rejection. The family permits of the EEA will no longer be valid after June 2021.

If you are a close family member of an EU, EEA or Swiss citizen who was living in the UK by 31 December 2020, you should consider the EUSS family permit. You may be eligible for an EEA Family Permit if you are a close family member or a dependant of an EEA national living in the UK. The relationship must have started by December 2020.

Immigration advisers: a case study

Higher numbers of applications were being refused because there was not enough evidence to corroborate the claim. You should always get advice from a qualified immigration adviser.

EUSS and the Firs-tier Tribunal in Switzerland

The EU Settlement Scheme EUSS allows Swiss andEEA nationals who are on a settled or pre-settled status in the UK to bring their family members to the UK after the UK leaves the EU. If you are not in the UK by 30th June 2021, you must apply for pre-settled status under the EU Settlement Scheme, which requires you to prove that your relationship began before that date. If you want to join your family in the UK before June 30, 2021, you should call UK Visa Consultants to book an appointment so that you don't miss out.

The Immigration Procedure for the EEA Family Permit Application

Is there a family permit for Italian residence cards?

It is not. You already have enough information. If your Italian residence card says "residence card of a family member of a union citizen", then you don't need a family permit from the EEA.

A Visit Visa for an EEA National

It is very difficult for overseas nationals to enter the UK without an EEA Family Permit. The EEA Family Permit can be used instead of applying for a standard visit visa for overseas family members who want to visit a family member in the EEA. If you are not a member of the EEA, you must show that you rely on them for your care, or that you are dependent on the national for your care.

It is important to show that the EEA national is in the UK and that they have permanent residence or have been in the UK for over 3 months. The family permits can be obtained from overseas visa issuing post. The overseas national does not need to be a resident in the country where they are applying for the form.

If the Entry Clearance Officer has strong grounds for asking the overseas family member to attend an interview, then they may do so. Payslips for the past 3 months can be used to show that an EEA national has been exercising their Treaty rights as an employee for a minimum of 3 months. There are other documents that can be referred to.

The EEA national must show that they have exercised their Treaty rights when they have been in the UK for over 3 months. The period of time that is called the probationary period is not likely to have an impact. If the EEA national is exercising their Treaty rights in the UK, they are usually required to provide their payslips and bank statements to show salary transfers into their account.

If you are a non-EEA national, you will need an EEA family permit to enter the UK as the family member of an EEA national. If the Immigration Officer is satisfied that the spouse of the national exercising Treaty rights in the UK is the person applying for entry to the UK, then the Immigration Officer is likely to allow entry to the UK. If there is a significant amount of time that has passed since the last EEA family permit expired, it is helpful to submit another application for an EEA family permit.
